Practical difficulties and solutions for the “three rights seperation” of the homestead in countryside

Abstract: The profound reform of the system orientation, right structure, interest relationship and legal logic of the reform of homestead “three rights seperation” will bring multiple practical problems to the interests balance, rural governance, state regulation and legal supply. To solve these problems, we need to rebuild the relationship between urban and rural land rights, go beyond the limitations of the static management of rural land, build a supporting mechanism of interest balance, improve the rural grass-roots governance system, optimize the state’s macro-control methods and build a legal system of “three rights separation” through the design of an open and systematic mechanism. In this way, it is to build up a system of free transformation and relative balance between paid use, paid vacations and moderate circulation.
